ORDER
This Criminal Miscellaneous Petition has been filed seeking to condone the delay of 196 days in filing the above Criminal Revision Case against the order dated 26.11.2024 passed in Crl.M.P.No. 40417 of 2024 in C.C.No.6912 of 2023 on the file of X Metropolitan Magistrate, Egmore, Chennai.
2. Mr.J.Prakasam, learned counsel for petitioners submitted that due to personal inconvenience as well as due to financial constraints, the petitioners are not able to instruct counsel on record to prefer the above Criminal Revision case and only during month of September 2025, they gave papers to him, as a result of which, there is a delay of 196 days in filing the above Criminal 2/4
Revision Case arose, which is neither willful nor wanton. Therefore, he filed this petition to condone the delay in filing the above Criminal Revision Case.
3. Considering the facts and circumstances, and the reasons stated by the petitioners in the affidavit seems to be justifiable one, this court is inclined to allow this petition on condition that the petitioners are directed to pay a cost of Rs.2000/- payable to the learned Government Advocate (Crl. Side) within a period of one week on or before 14.10.2025. Registry is directed to number the Criminal Revision Case if it is otherwise found to be in order and post the matter on 14.10.2025.
