ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. This case is registered for alleged offences under Sections 395 r/w 397 of the Indian Penal Code. The incident occurred on 16.04.2011. The allegation is that about 460 grams of gold and 4 1⁄2 kgs of silver were stolen from the de facto complainant. It is seen that the split up case went to trial and in S.C.No.167 of 2022 and the accused therein were also acquitted. The allegations are similar against the present accused also. The de facto complainant has no objection in closing the case as part of the property has been recovered and handed over to de facto complainant. No useful purpose will be served in continuing the case. Any further continuation of the proceedings will also impinge upon their right to speedy trial. 3. Accordingly, the case in P.R.C.No.6 of 2018 of Judicial Magistrate Court, Dharapuram, Dharapuram Taluk, Tiruppur, stands quashed. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
