PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, to direct the Respondents 1 to 4 to take the immediate action to dispose the Petitioner's representation dated 26.11.2024 seeking to change the adjudicating authority by fixing reasonable time. ORDER

The present writ petition is filed praying for a writ of mandamus, to direct the Respondents 1 to 4 to take the immediate action to dispose the Petitioner's representation dated 26.11.2024 seeking to change the adjudicating authority by fixing reasonable time.

At the outset it is submitted by the learned Special Government Pleader that there are certain allegations made against the officer which is unwarranted and baseless, to which the learned counsel for the petitioner would submit that they no longer intend to press those allegations and he would instead confine his prayer that his representation dated 26.11.2024 be considered and appropriate orders be passed within a particular time frame. 2/5

3. At this stage the learned Special Government Pleader would submit that the representation dated 26.11.2024 would be considered and orders would be passed in accordance with law within a time frame fixed by this Court.

4. In view thereof, the writ petition is disposed of with a direction to the by the 2nd respondent to consider the petitioner's representation dated 26.11.2024 and pass appropriate orders in accordance with law after affording the petitioners a reasonable opportunity of hearing within a period of 4 weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law.
