ORDER

The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 303(2), 326(a) of BNS, 2023 read with Section 21(1) Mines and Minerals (Development & Regulation) Act, 1957, in Crime No.394 of 2025 on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioners is that the petitioners joined hands with the other accused taken away 4 units sand from the Gingee river.

3. The learned counsel for the petitioners submitted that the falsely implicated in this case. He further submitted that the petitioners are having no previous case against them and hence, he prays for anticipatory bail.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reported that though the petitioners claiming themselves as vehicle owner and they actively involved in an illegal quarrying the sand from the river and also caused damage to the ecology. He further submitted 2/4

that the petitioners are having no previous cases against them and hence, he opposed to grant anticipatory bail to the petitioners.

5. Considering the fact that the petitioners have not only involved in quarrying the river sand illegally, but also causing damage to the ecology, I am not inclined to grant anticipatory bail and if the anticipatory bail is granted, they would further involve in similar offence, hence, this Criminal Original Petition stands dismissed.
