ORDER
This Criminal Original Petition has been filed by the petitioner, who apprehend arrest, seeking anticipatory bail in Crime No.349 of 2024, registered for the offence under Sections 296(b), 115(2), 118(1) and 351(3) of BNS. 1/4
2. The case of the prosecution is that due to previous enmity, a wordy quarrel arose between the petitioner and the defacto complainant. The petitioner, along with his brother abused the defacto complainant with filthy language, assaulted him with wooden log, resulting in injuries. Hence, the case.
3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner.
4. Learned Government Advocate (Crl.Side) appearing for the respondent police, while objecting for grant of anticipatory bail to the petitioner, submitted that the petitioner has got four previous cases. He also submitted that the injured has been discharged from the hospital. 2/4
5. Heard the learned counsel appearing for the petitioner, the learned Government Advocate (Crl.Side) for the respondent Police and perused the materials available on record.
6. Taking into consideration that the gravity of offence committed by the petitioner and that he has got four previous cases, this Court is not inclined to grant anticipatory bail to the petitioner.
