(Order of the Court was made by the Hon'ble S.S.Sundar J.) This Miscellaneous Petition is filed to condone the delay of 298 days in filing the above Civil Miscellaneous Appeal.

Learned counsel representing the learned counsel for the appellant submitted that the appellant-department has given instructions to withdraw the appeal as the department is decided to file a review before the Appellate Tribunal in terms of the judgment of the Hon'ble Supreme Court in Union of India and Another Vs. M/s. G.Anapati Dealcom Pvt Ltd (Review Petition [Civil] No. 359 of 2023 in Civil Appeal No. 5783/2022 dated 18.10.2024)

3. In view of the aforesaid submissions made by the learned counsel, the delay of 298 days in filing the above appeal is condoned. Registry is directed to number the appeal immediately.
