Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, directing the respondents to measure and survey the property comprised in Survey Nos. 101/1B extent of 0.04.86 Hect. and 101/D an extent of 0.19.43 Hect. and Survey No.101/2 at measuring of 0.07.00 Hect. and Patta No. 386 at Akkamanahalli village and post 636704, Dharmapuri Taluk and District and demarcate the areas owned by the petitioner by fixing a boundary stone and by considering the representation of the petitioner dated 09.07.2025. O R D E R

This Writ Petition has been filed for a direction directing the respondents to measure and survey the property comprised in Survey Nos.101/1B an extent of 0.04.86 Hect. and 101/D an extent of 0.19.43 Hect. and Survey No.101/2 an extent of 0.07.00 Hect. and Patta No. 386 at Akkamanahalli village and post 636704, Dharmapuri Taluk and District and demarcate the areas owned by the petitioner by fixing a boundary stone and by considering the representation of the petitioner dated 09.07.2025.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

The case of the petitioner is that he is the owner of the lands comprised in Survey No.101/1B an extent of 0.04.86 Hect., Survey No.101/D an extent of 0.19.43 Hect. and Survey No.101/2 an extent of 0.07.00 Hect. situated at Akkamanahalli village and post, Dharmapuri Taluk and District. In order to survey the said lands, he submitted representations before the respondents. However, the respondents did not take any steps to survey the aforesaid lands so far. 2/5

In view of the above, the 2nd respondent is directed to survey the petitioner's aforesaid lands based on the title deed produced by the petitioner, after issuance of notice to the adjacent land owners and counter parties, if any, and to serve the survey report to the petitioner within a period of six weeks from the date of receipt of a copy of this order. It is made clear that, if the surveyor concerned is obstructed by third parties while surveying the subject land, the said surveyor can approach the jurisdictional police seeking police aid and on such request, the jurisdictional police shall provide adequate police protection to the surveyor.

5. With the above directions, this writ petition is disposed of. There shall be no order as to costs.
