Respondent(s) PRAYER This Petition has been filed seeking for issuance of a Mandamus, to direct the respondents to forthwith extend the benefit of G.O.Ms. No.39, Rural Development Department, dated 07.05.2013 by granting special time scale of pay of Rs.1300-3000 + 300/- with effect from 15.09.2010 continuously with all arrears to the petitioner.

By consent of both parties, this Writ Petition is taken up for final disposal at the stage of admission itself.
2.This writ petition has been filed seeking for issuance of a Mandamus, to direct the respondents to forthwith extend the benefit of G.O.Ms. No.39, Rural Development Department, dated 07.05.2013 by granting special time scale of pay of Rs.1300-3000 + 300/- with effect from 15.09.2010 continuously with all arrears to the petitioner.
3.Heard both sides and perused the materials available on record. 4.The case of the petitioner is that he had been appointed as Sanitary Worker on 01.09.2007 on monthly payment of Rs.600/-. Subsequently, he was paid a consolidated pay of Rs.1390/- per month and presently, the petitioner is getting a salary of Rs.3700/- per month. While so, the Government has issued G.O.Ms.No.39, Rural Development Department, dated 07.05.2013, to the effect that the sanitary workers, working on daily wage basis/consolidated pay, on completion of 3 years of service as on 15.09.2010, should be brought into special time scale of pay of Rs.1300-3000+300/-. However, the petitioner's name was not included in the list, due to which, he is unable to get the benefit of the said Government Order dated 07.05.2013.
According to the petitioner, he is legally entitled to get the benefit under G.O.Ms.No.39, dated 07.05.2013, while his juniors are enjoying the benefit of the said Government Order. Therefore, he sent a representation to the respondents on 20.08.2025 in this regard. Since no response is forthcoming from the respondents, the petitioner has come forward to file the present Writ Petition.
5.Mr.R.U.Dinesh Raj Kumar, learned Additional Government Pleader appearing for the respondents, would submit that G.O.Ms.No.39, Rural Development Department, dated 07.05.2013 pertains to Panchayat Clerks and not to Sanitary Workers.
6.Per contra, learned counsel for the petitioner would submit that the 3 rd and 4 th respondents in their communications/recommendations, have referred to the said Government Order.

In the light of the above, without going into the merits of the case, this Court is inclined to issue a direction to the second respondent to consider and pass appropriate orders on the petitioner's representation dated 20.08.2025, on its own merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order and communicate the same to the petitioner.
8. With the above direction, this Writ Petition stands disposed of. No costs.
