O R D E R

This writ petition is filed seeking a direction to the respondents to dispose of the representation of the petitioner dated 28.8.2023 to remove the cattle shed of the government Canal and Street in front of the petitioner's plot in Survey No.162/7A situate at Melmonavur Village, Vellore Taluk, Vellore District within a stipulated time frame.

2. Learned Addl. Government Pleader take notice for respondents 1 to 3 and has no objection to this Court passing orders. Since no adverse order is passed against the 4th respondent, notice to the 4th respondent is dispensed with.

3. It is the case of the petitioner that he purchased the plot in Survey No.162/7A and is in possession of the same and when he tried to put up construction in the said plot, the 4th respondent prevented the petitioner from entering into the plot and is occupying the same and has put cattle shed on the Government Canal and Street in front of his plot and is giving trouble to the petitioner. Therefore, the petitioner made a representation to the 2nd respondent to remove the cattle shed which has been put up on the Government land and since no action has been taken on the representation, the present writ petition has been filed.

4. Learned counsel appearing for the petitioner submits that it would suffice Page No:2/4

if this Court directs the 2nd respondent to consider the representation of the petitioner and pass orders for removal of the cattle shed put up on the Government land in the manner known to law within a stipulated time frame.

In view of the limited relief sought for, this Court, without going into the merits of the issue, directs the petitioner to submit a copy of the representation along with a copy of this order to the 2nd respondent within a period of two weeks from the date of receipt of a copy of this order and on such representation being filed the 2nd respondent, after affording an opportunity of hearing to the 4th respondent, the petitioner and other persons, who are interested, consider the representation and dispose of the same in accordance with law within a period of four weeks thereafter.

6. This writ petition is disposed with the aforesaid direction. There shall be no order as to costs.
