ORDER

The Criminal Original Petition has been filed to call for records and quash the proceedings in C.C.No.71 of 2016 on the file of the Judicial Magistrate-I, Tindivanam as against the petitioner herein.

2. Learned counsel for the petitioner would submit that the cheque which has been given towards security deposit has been misused by the Complainant. He further submits that the Complainant has also suppressed the material facts and has also not given the source of income of the cheque for the payment made to the petitioner.

3. This Court is of the opinion that these grounds are matter for trial and the case is pending from 2016. The trial Court has also commenced the trial and at this stage, the proceedings before the trail Court cannot interdicted.

4. Accordingly, the case in Crl.O.P.No.31246 of 2025 stands dismissed. Consequently connected miscellaneous petition is closed.
