ORDER

This Criminal Original Petition has been filed to direct the second respondent to file the final report in the First Information Report registered in Crime No. 1058/2023 pending before the second respondent, within a time frame fixed by this Court.

2. The case of the prosecution is that the accused has been introduced to the petitioner/defacto complainant by the Manapuram Bank Manager to recover and sell his 24 grams jewellery that was under mortgage and petitioner also paid a sum of 2,89,310/- to the Manapuram Bank through online transaction and balance amount of Rs.80,000/- has been paid by way of cash. The further case of the prosecution is that after the amount has been paid by the petitioner, the accused had re-mortgaged the jewels and swindled the amount paid the

petitioner and thereby cheated him. In this regard, the petitioner had preferred a complaint before the second respondent. The grievance of the petitioner is that though a case has been registered in Crime No.1058 of 2023 for the offences under sections 406 and 420 of IPC, there is no progress in the investigation. Hence, seeks aforesaid direction.

3. The learned Government Advocate [Criminal Side] appearing for the respondent on instructions submitted that the investigation is in progress and they will file the final report within a period of three months.

4. In view of the above submissions, this Criminal Original Petition is disposed of with a direction to the second respondent to expedite investigation and file the final report within a period of three months from the date of receipt of a copy of this Order.
