ORDER

This writ petition is filed for the relief of a mandamus, directing the respondent to reinstate the petitioner with continuity of service, backwages and all other attendant benefits.

2. The petitioner was appointed as a Driver in the year 2007, through Employment Office by the Metropolitan Transport Corporation (Chennai) Ltd., and he was posted at Adyar Transport Depot to work as a Driver. His services were regularised in the year 2009. While so, on 04.04.2016 the petitioner fell sick and underwent medical treatment.

3. The petitioner's case is that after his treatment, he approached the Branch Manager of the respondent corporation and requested to reinstate him in duty. It is his further case that the Branch Manager has made a complaint against the petitioner. Thereafter, an enquiry was conducted and an ex parte order was passed dismissing the petitioner 2/6

from service on 07.03.2022.

4. It is his further case that the approval petition filed by the management in AP.No.61 of 2022, was dismissed by the Joint Commissioner of Labour, Chennai on 08.07.2025. Thereafter, the petitioner sent a representation dated 01.08.2025, seeking to reinstate him with continuity of service with all attendant benefits. Since the respondent has not considered the same, the present Writ Petition has been filed.

5. Heard the learned counsel on either side and perused the records.

6. From the records, it is seen that the approval petition filed by the respondent management was dismissed on 08.07.2025. Thereafter, the petitioner sent a representation to the respondent seeking to reinstate him with continuity of service, backwages and all attendant 3/6

benefits. Aggrieved by the inaction, the petitioner is before this Court.

7. Considering the fact that the approval petition filed by the management has been dismissed and also the fact that the petitioner's representation dated 01.08.2025 has not been considered till date, this Court, without going into the merits of the petitioner's claim, directs the respondent to dispose of the petitioner's representation dated 01.08.2025, on its own merits and in accordance with law within a period of 4 weeks from the date of receipt of a copy of this order.

8. With the above direction, the writ petition stands disposed of. No costs.
