PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, pleased to issue Writ of Mandamus, Directing the respondents 1 to 5 to reclassify the land of padhai puramboke and converted into Natham and to issue house site Patta to the petitioner in respect of the house property to an extent of 0.00.24 Sq.mtr comprised in S.No.94 situated at Koonandiyur Revenue Village Mettur TAluk and Salem District by considering the petitioners representation dated 05.12.2024. ORDER

The Writ Petition has been filed seeking issue of pathway patta in respect of a pathway (Battai) which has been occupied by the Writ Petitioner. In fact, in an earlier Writ Petition, the first bench of this Court has passed the following order:- 2.Learned Special Government Pleader submits that the encroachment exists on the public pathway in S.F.Nos.93, 94 and 95 in Koonandiyur Village, Mettur Taluk, Salem District. The authorities would take necessary steps for removal of the encroachment. The authorities shall initiate the process for removal of encroachment in accordance with law within two months from today and shall take the proceedings to the logical end.

2.Pursuant to the order, it is informed by Mr.Selvendran, the 2/4

learned Special Government Pleader, that notices have been issued to the encroachers.

3.Heard the learned counsels on either side. The learned Special Government Pleader takes notice on behalf of the respondents. 4.The writ petitioner has now come forward with this request in the above writ petition to get over the notice that have been issued pursuant to the order of first bench of this Court. The respondent is not entitled to the relief. Accordingly, the Writ Petition is dismissed No costs.
