ORDER

The petitioner has filed this petition to suspend the sentence and enlarged on bail imposed in Spl.SC No.42/2023, on the file of the Fast Track Court Exclusively to Deal with offences under the POCSO Act at Puducherry, against the petitioner/appellant/accused pending disposal of the above Crl.A.No.594/2024.

2. The learned counsel for the petitioner submitted that this is the fourth application filed by the petitioner seeking suspension of sentence. The petitioner has been in custody for one year and ten months, and seeks suspension of the remaining sentence on any condition imposed by this Hon'ble Court. He further submitted that the petitioner is the husband of the victim girl's sister. It is alleged that he committed penetrative sexual assault upon the victim girl. Subsequently, the victim girl married another person and has a son through that marriage. However, even after her marriage, the petitioner continued to disturb her family life by showing her photographs and causing mental agony, which

ultimately led to her separation from her husband. Despite this, the petitioner continues to interfere in her personal life.

3. According to the prosecution, the petitioner is a habitual sexual offender and has 13 previous criminal cases, including one registered under Section 302 IPC.

4. Considering the gravity of the offence, the petitioner's conduct, and his Criminal antecedents, this Court finds no merits in the request for suspension of sentence.
