CMP No.8704 of 2025 in CMA SR No.170434 of 2024 S.SOUNTHAR, J.

This petition has been filed to accept the cause title as shown in the CMA.

2. It is seen from the affidavit filed in support of the petition and also the additional affidavit dated 25.04.2025, the legal heirs of the deceased Ayyasamy Mooper were already on record and his death had not been reported before the first appellate court. Since the legal heirs of the deceased Ayyasamy Mooper were already on record, there was no abatement.

3. Being satisfied with the reasons assigned in the affidavit filed along with the petition, this petition is allowed.

4. Registry is directed to number the condone delay petition and list the same for hearing on 30.04.2025.
