ORDER

Apprehending arrest in connection with Crime No.911 of 2024 registered for the offences punishable under Sections 297 of BNS r/w 5 and 7(3) of Lotteries Regulation Act, the present petition has been filed seeking anticipatory bail.

The case of the prosecution is that, based on secret information received from the informant, the respondent police went to the TSR Nagar, Kandamanadi and found that A1 and A2 were selling banned other State lottery through online, on seeing them, they tried to escape from there and they caught hold of them and they were remanded. Subsequently, based on their confession, the petitioner's name was included in the FIR. Hence, this case.

3. Pleading innocence on the part of the petitioner, false implication in the case, learned counsel for the petitioner seeks indulgence of this Court. He further submits that this is the second petition seeking for anticipatory bail. He would submit that the petitioner is an innocent person and has not committed 2/5

any offence as alleged by the prosecution. He would submit that he has been falsely implicated in this case and only based on the confession statement of arrested accused, he was implicated in this case. He would submit that the petitioner is ready to abide by any stringent condition that may be imposed by this court.

The case of the prosecution, as putforth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for grant of bail, is that the petitioner herein is the owner of the lottery business and involved the other accused to sell banned other state lottery through online. He would further submit that 6 previous cases similar in nature pending against him.

Heard the learned counsel for the petitioner, the learned Government Advocate (Crl. Side) appearing for the respondent police and perused the materials available on record including the FIR. 6.

Taking note of the facts and circumstances of the case, the submissions made by the learned counsel on either side and also taking note of 3/5

the fact that 6 previous cases similar in nature pending against the petitioner and also there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner and Accordingly, this Criminal Original Petition is dismissed.
