This petition has been filed seeking to condone the delay of 54 days in filing the appeal against the acquittal judgment passed in S.C.No.97 of 2015 dated 20.08.2024 on the file of the learned Principal District and Sessions Judge, Tiruvarur.

2. Ms.S.Karpagapriya, learned counsel entered appearance for R1 and Mr.S.Saran Prasad, learned counsel entered appearance for R2. Mr.M.P.Yuvaraj, learned counsel appearing for respondents 3 and 4 has no objection in the petition being allowed.

3. Though notice has been served on 5th respondent and his name has been printed in the cause list, none appeared on his behalf.

4. This Court is convinced with the reasons assigned in the affidavit filed in support of the petition. Since the delay has been satisfactorily explained, the delay is condoned and this petition is allowed.

5. Registry is directed to number the above Criminal Appeal, if it is otherwise in order and post the same in usual course.
