ORDER

This Criminal Original Petition has been filed seeking modification of the condition imposed by the learned Principal District and Sessions Judge, Chengalpattu in Crl.M.P.No.2794 of 2025, with respect to the appearance of the petitioner/accused before the respondent police.

2. Heard the learned counsel for the petitioner and perused the materials available on record carefully.

3. The petitioner has approached this Court seeking modification of one of the conditions imposed by the learned Principal District and Sessions Judge, Chengalpattu, while granting bail to him in Crl.M.P.No.2794 of 2025. The said condition relates to the periodic appearance of the petitioner before the respondent police.

4. On perusal of the records, it is seen that the petitioner has directly filed the present petition before this Court seeking modification of the said condition without first approaching the very same learned Judge, who had originally granted bail to him.

5. It is a well-settled principle that when a condition of bail is imposed by a competent Court, the party seeking modification of such condition must approach the same Court which passed the original order, unless there are exceptional circumstances warranting intervention by this Court.

6. In the present case, no such exceptional circumstances have been shown. Therefore, this Court is of the view that the petitioner must first approach the learned Principal District and Sessions Court, Chengalpattu, who granted bail, seeking appropriate modification of the condition. 3/6

7. In view of the above, this Criminal Original Petition is dismissed. However, liberty is granted to the petitioner to approach the learned Principal District and Sessions Judge, Chengalpattu, with a proper petition seeking modification of the bail condition.
