The petitioner herein apprehend arrest at the hands of the respondent police for the offences punishable under Sections 21(1) of Mines and Minerals (Development & Regulation) Act, 1957 and Section 303(2) of BNS, 2023 in Crime No.247 of 2025, on the file of the respondent Police, seek anticipatory bail.

2. The allegation against the petitioner is that the petitioner was found in illegal transportation of 2 units of river sand. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that, petitioner has no previous cases.

5. Heard the learned counsels on either side and perused the materials 2/4

available on record.

6. Considering the gravity of the offence committed by the petitioner and he is involved in damaging ecology by illegal quarrying in the water body, this Court is not inclined to grant anticipatory bail to the petitioner.
