ORDER

This Court heard the learned counsel for the petitioner and went through the materials available on record. 2.

This Court expressed its mind that this Court is not inclined to exercise its discretion considering the facts of the case. This Court also made it clear that liberty will be granted to the petitioner to file the appeal before the Commissioner of Customs (Appeals) and the petitioner can raise all the grounds before the Appellate Authority.

The learned counsel for the petitioner submitted that the petitioner will reserve all the rights to agitate the dispute before the appellate authority.

In view of the above, this writ petition is disposed of by granting liberty to the petitioner to move the appellate authority

within a period of thirty days from the date of receipt of a copy of this order. It is left open to the petitioner to raise all the grounds before the appellate authority and the same shall be considered on its own merits and in accordance with law. No costs. Consequently, the connected miscellaneous petition is closed.
