Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondent herein to provide the petitioner herein with the copy of full text of the award in Award proceedings made in Na.Ka.No. 765/ 2021/ A1 dated 27.05.2025 and make a reference pursuant to the Reference application dated 14.07.2025 filed by the petitioner within a reasonable time as prescribed under the Tamil Nadu Highways Act 2001 read with the Right to fair compensation and transparency in Land acquisition Rehabilitation and Resettlement Act 2013 to the Appropriate authority 1/6

ORDER

This writ petition has been filed to direct the respondent herein to provide the petitioner herein with the copy of full text of the award in Award proceedings made in Na.Ka.No. 765/ 2021/ A1 dated 27.05.2025 and make a reference pursuant to the Reference application dated 14.07.2025 filed by the petitioner.

2. Mr.M.R.Gokul Krishnan, learned Additional Government Pleader, takes notice on behalf of the respondent.

3. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself.

4. The learned counsel for the petitioner would submit that in this case, the petitioner's land was acquired by the Tamil Nadu Highways 2/6

Department vide Notification dated 28.02.2020 for the purpose of constructing an overhead flyover. Subsequently, an award was passed on 27.05.2025 by fixing a meagre amount as compensation. Aggrieved over the same, the petitioner filed an application dated 14.07.2025 to the respondent to refer the matter to the appropriate authority for determining the enhanced compensation amount. However, the said application was not considered by the respondent till date. Hence, this writ petition.

5. In reply, the learned Additional Government Pleader appearing for the respondent would submit that the application filed by the petitioner will be considered by the respondents within a period of 2 weeks. Hence, he requested this Court to pass appropriate orders.

6. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondent and also perused the entire materials available on record. 3/6

7. In the case on hand, the petitioner's land was acquired by the Tamil Nadu Highways Department vide Notification dated 28.02.2020 for the purpose of constructing an overhead flyover. Subsequently, an award was passed on 27.05.2025 by fixing a meagre amount as compensation. Aggrieved over the same, the petitioner filed an application dated 14.07.2025 to the respondent to refer the matter to the appropriate authority for determining the enhanced compensation amount. However, the said application was not considered by the respondent till date.

8. In view of the above, this Court directs the respondent to refer the petitioner's application dated 14.07.2025 to the Competent Civil Court within a period of 2 weeks from the date of receipt of a copy of this order.

9. With the above direction, this writ petition is disposed of. No cost.
