The petitioner seeks a direction from this Court to the District Consumer Redressal Commission Chennai (South), Chennai to dispose of the execution petition in EA.No.26 of 2023 in C.C.No.210 of 2019, within the time frame.

2. The petitioner has obtained an order in his favour from the District Consumer Redressal Commission Chennai (South), Chennai on 27.12.2022, in and by which the opposite party, namely, the respondents herein were directed to jointly and severely refund a sum of Rs.1,08,000/- received by them under receipts dated 11.11.2016, together with interest at 9% per annum and also pay a sum of Rs.25,000/- towards deficiency of service, unfair trade practice and mental agony and a sum of Rs.5000/- towards costs. 2/6

3. Since the above order has not been complied with the petitioner filed execution proceedings in E.A.No.26 of 2023 seeking the arrest of the Chairman / 2nd respondent. The said petition was filed on 12.04.2023. The matter has been adjourned for the counter of R1 and R2 and payment since 26.06.2023, without the petitioner seeing the colour of the coin. Thereafter, from 27.03.2024, the matter has been adjourned for payment. From 09.08.2024, the matter has been adjourned for enquiry and for settlement. Thereafter, the matter has been adjourned stating that an appeal in F.A.No.1205 of 2023 is pending. There is no stay in the appeal.

Therefore, considering the fact that the application which is filed to execute the order passed by the District Consumer Redressal Commission Chennai (South), Chennai, is pending since 2023, a direction is issued to the District Consumer Redressal Commission Chennai (South), Chennai, to dispose of the execution petition, within a period of 2 months from the date of receipt of a copy of this order. 3/6
