Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records of the 1st respondent to call for the records pertaining to impugned order dated 24th March 2025 and quash same as illegal and consequently directing the 1st Respondent to permit the petitioner to attend 5th Semester Classes of III year B.SC (BMS) offered by the 1st Respondent institution 1/4

ORDER

This writ petition has been filed challenging the order passed by the first respondent dated 24.03.2025 thereby refusing to grant permission to retain in the program since the petitioner is not eligible to proceed to any of the semesters without completing the first semester as per the regulations. 2.

The petitioner had joined to pursue his B.Sc.(BMS) in the first respondent institution. On several occasions, the petitioner was suspended on the allegations such as splitting acid inside the lab and harming other students. That apart, the petitioner failed in 21 subjects out of 22 subjects till the completion of 2nd year. As per the regulations, he is not eligible to proceed his further semesters without completing the first semester. Therefore, the petitioner was rightly denied for continuation of his course. That apart, the petitioner did not even mention in the affidavit that when the 2/4

petitioner joined in the first respondent college and the entire affidavit is bereft of facts. Only after detailed enquiry conducted by the first respondent, the present order came to be passed. Therefore, this court finds no infirmity or illegality in the impugned order. As such, this writ petition is liable to be dismissed.

Accordingly, this writ petition is dismissed. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
