Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the second respondent to re-determine the compensation awarded to the petitioner's lands acquired at Karasur Revenue Village in Award No.2/2008, to a sum of Rs.21,261/- per Are, based on the petitioner's application under Section 28A of the Land Acquisition Act 1894 dated 22.03.2019, pursuant to the enhanced compensation award passed in LAOP No.110 of 2012 on the file of II Additional District Judge, Puducherry. ORDER

The relief sought for in this writ petition is to direct the second respondent to re-determine the compensation awarded to the petitioner's lands acquired at Karasur Revenue Village in Award No.2/2008, to a sum of Rs.21,261/- per Are, based on the petitioner's application under Section 28A of the Land Acquisition Act 1894 dated 22.03.2019, 2/6

pursuant to the enhanced compensation award passed in LAOP No.110 of 2012 on the file of II Additional District Judge, Puducherry.

2. Mr.R.Sridhar, learned Additional Government Pleader takes notice on behalf of the respondents. By consent of both the parties, this writ petition is taken up for final hearing at the admission stage itself.

The case of the petitioners is that the first respondent herein acquired the petitioners' lands situated in the Sedarapet and Karasur Revenue Village of Villianur Taluk for the purpose of setting up of "Special Economic Zone" by invoking the urgency provision under Section 17(4) of the Land Acquisition Ac. Since the final compensation determined by the third respondent was too low, many lands owners preferred an application, seeking enhancement of compensation. By which one Mr.S.G.Jothy, one of the land owners preferred a reference application in LAOP No.110 of 2012, seeking enhancement of compensation and the same was allowed by enhancing the compensation from Rs.12,352/- per are to Rs.21,261/- per are, along with 30% solatium 3/6

and 12% additional market value. By virtue of the said order, petitioners herein made an application dated 22.03.2019, before the second respondent seeking to re-determine the compensation awarded to their land. However, till date, the same was not considered. Hence, the petitioners have come forward with the present writ petition.

4. Though many grounds have been raised in this writ petition, learned counsel for the petitioners submitted that, it would suffice, if this Court issues direction to the second respondent to consider the petitioners' application dated 22.03.2019.

5. Learned Additional Government Pleader appearing for the respondents submitted that the petitioners' application dated 22.03.2019 would be considered and appropriate orders passed, within a time frame that may be fixed by this Court.

6. Heard the learned counsel on either side and perused the 4/6

materials available on record.

Considering the limited relief sought for by the learned counsel for the petitioners, this Court without going into the merits of the case, directs the second respondent to consider the petitioners' application dated 22.03.2019, after conducting enquiry, within a period of eight weeks from the date of receipt of a copy of this order. With the aforesaid direction, this writ petition is disposed of. No costs.
