ORDER

The present petition has been filed seeking to modify the condition imposed in para 5(b) in the order of this court dated 11.12.2024 in Crl.O.P.No.25219 of 2024.

2. The learned counsel appearing for the petitioner would submit that this court while granting bail to the petitioner has imposed a condition that, he shall surrender his passport before the Trial Court. He would further submit that the petitioner has not obtained any passport till date and he has also filed an affidavit of undertaking to that effect before this court. https://www.mhc.tn.gov.in/judis

3. The learned Special Public Prosecutor (NCB) appearing for the respondent would submit that, at later point of time, if it is found that the petitioner has any passport, the respondent may be permitted to file an application seeking cancellation of bail.

4. Heard both sides and the submissions of the learned Special Public Prosecutor (NCB) for the respondent is recorded.

5. Considering the facts and circumstances of the case, the conditional bail granted by this court in Crl.O.P.No.25219 of 2024 by order dated 11.12.2024 in 'Paragraph 5(b)' viz. 5(b). the petitioner shall surrender his passport to the before the trial Court, is hereby "deleted" and the other conditions shall remains unaltered.

6. With the above modification, this Criminal Original Petition is modified.
