ORDER
(Order of the Court was made by the Hon'ble Chief Justice) At the outset, Sri.Krishna, Advocate, states that respondent No.3 died on 06.01.2023 and that he has given the details of legal heirs to Ms.Sumathy, who undertakes to file a memo during the course of the day. Sri.Krishna states that he is also authorised by the legal heirs to represent them in this matter.
2. On receipt of the memo to be filed by M/s.Sumathy, the Registry shall carry out the amendment during the course of this week.
3. The delay in filing the appeal is only four days. Sri.Krishna, representing the legal heirs of respondent No.3, has no objection if the delay is condoned, keeping open the rights and contentions on the merits of the matter.
Accordingly, keeping open the rights and contentions, the delay is condoned. Application is disposed of.
