3. United India Insurance Co. Ltd., No.21, Raja Annamalai Road, Chennai - 600 084. .. Respondents This case is taken up for settlement before the Lok Adalat. Both the parties are present. The learned counsel for the appellant Mr.T.Chandrasekaran, and the first respondent are present. The second respondent set exparte before the Tribunal. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows: TERMS OF SETTLEMENT The Tribunal has awarded a sum of Rs.6,28,275/- with interest at 7.5% per annum and costs, from the date of petition, till the date of

realisation. Challenging the quantum of compensation, the appellant / Transport Corporation had preferred the present appeal.

2. After due deliberation and consultation, both the parties have agreed to settle the claim for a sum of Rs.9,50,000/- (Rupees Nine Lakhs fifty thousand only) in full quit.

3. The appellant/ Transport Corporation is directed to deposit the modified award amount Rs.9,50,000/- n full quit less the amount of Rs.25,000/- which was already deposited to the credit of MCOP.No.46 of 2016 before the Motor Vehicles Accident Claims Tribunal, III Additional District Judge, Virudhachalam, within a period of eight weeks from the date of receipt of a copy of this order. On such deposit, the claimant / the 1st respondent is entitled to withdraw the award amount.

4. On such deposit being made, the Tribunal is directed to transfer the above said award amount to the Bank account of the 1st respondent / claimant by way of NEFT / RTGS, on proper identification, in accordance with the terms of the award, without insisting on any formal permission petition.

5. The award is modified accordingly and the Civil Miscellaneous Appeal is disposed of. Consequently, connected miscellaneous petition is closed.
