ORDER
The petitioner has filed this writ petition seeking a Writ of Certiorarified Mandamus, to call for the records of the 2nd respondent in Na.Ka.No.3028313/2025/B2 dated 18.08.2025 and quash the same and thereby, direct him to act in accordance with the provision under Section 68(2) to (4) of the Waqf Act 1995.
2. Mr.Mohammed Fayaz Ali, learned counsel, accepts notice on behalf of the 1st respondent and Mrs.S.Anitha, learned Special Government Pleader, accepts notice on behalf of the 2nd respondent. In view of the consent expressed by the parties, this writ petition is taken up for final disposal at the stage of admission itself. Page No.2 of 6
3. The Paramathi Tippu Sulthan Periya Pallivasal Waqf is under the supervisory control of the Tamil Nadu Waqf Board. Vide order, dated 16.11.2023, the petitioner and others have been appointed as Joint Muthawalli to manage the affairs of the said waqf for the period from 26.09.2023 to 25.09.2026. However, the possession was not handed over by the private respondents, thereby the petitioner has made an application before the 2nd respondent on 22.12.2023. Subsequently, though enquiry was conducted, however, possession was not handed over to the present Muthawallis. Though the 2nd respondent has sent summonses to the parties, however, without jurisdiction, the 2nd respondent has issued the impugned letter dated 18.08.2025, stating that a letter has been sent to the 1st respondent for further action. Challenging the same, the petitioner association has filed this writ petition.
4. Though very many grounds have been raised in this writ petition, learned counsel appearing for the petitioner submits that, it would suffice, if this Court issues a direction to the 2nd respondent to implement the order dated 16.11.2023, within a time frame that may be fixed by this Court.

In view of the limited request sought for by the learned counsel appearing for the petitioner, this Court, without interfering with the impugned order, directs the 2nd respondent to implement the order, dated 16.11.2023, within a period of eight (8) weeks from the date of receipt of a copy of this order, if there is no legal impediment, after providing an opportunity of personal hearing to the respondents 3 to 6.
6. With the above direction, this Writ Petition is disposed of. No costs.
