O R D E R

The petitioner, who was arrested and remanded to judicial custody on 04.11.2024, pursuant to a non-bailable warrant issued in S.C.No.04 of 2024 on the file of Additional District Judge (FTC), Arni, Tiruvannamalai District, for the offences punishable under Sections 404, 120(b), 302, 201, 302 r/w 34 of IPC in Crime No. 468 of 2011, on the file of the respondent 1/6

police, seeks bail.

2. The allegation against the petitioner is that the petitioner is involved in the case of murder and earlier, he was released on bail and was appearing before the Trial Court in S.C.No.38 of 2014. Subsequently, he had not appeared from 05.02.2024 and since the petitioner had not appeared for longer period, the case against this petitioner was split up and numbered as S.C.No.4 of 2024. Thereafter, a non-bailable warrant was issued against him on 05.02.2024 and the same was executed on 05.11.2024.

3. Learned counsel appearing for the petitioner submitted that due to ill health, he has not appeared before the Trial Court. He submits that petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner. 4.

The learned Government Advocate (Crl. Side) appearing for the respondent, while opposing for grant of bail to the petitioner, reiterated the prosecution case and reported that originally the case is of the year 2014. The petitioner had jumped bail and consequently, the case was spilt up and the trial is progressing. He further submits that already PW.1 to P.W.4 were examined and further witnesses are yet to be examined and hence, opposed to grant bail to the petitioner.

Considering the facts and circumstances of the case, allegation against the petitioner, submissions made by the learned counsels on either side, considering the fact that the petitioner being absconded for a longer period, this Court is not inclined to grant bail to the petitioner.
