ORDER

The Civil Revision Petition is filed challenging the order passed by the learned Magistrate dismissing the application filed by the petitioner seeking appointment of Advocate Commissioner to take downloaded videos filed by the petitioner for expert opinion to decide the authenticity of the same.

2. The respondent herein filed a domestic violence complaint against the petitioner under the provisions of the Domestic Violence Act by alleging incidence of domestic violence. In the said matter, the petitioner filed instant application stating that he got objectionable videos found from the net. The authenticity of the same shall be decided by subjecting it to the scrutiny of an expert and the said application was dismissed. Aggrieved by the same, the petitioner has come before this court.

3. The learned counsel for the petitioner vehemently contended that the petitioner shall be given a fair opportunity to prove the case before the learned Magistrate and therefore, the application filed by the petitioner seeking expert opinion should have been allowed.

4. The respondent filed a complaint under the provisions of the Domestic Violence Act alleging incidence of domestic violence. Therefore, the issue to be decided in the domestic violence complaint is proof or otherwise of allegations of domestic violence made by the respondent. The videos produced by the petitioner will no way help the Court to decide the issues involved in the domestic violence complaint. Therefore, the learned Magistrate rightly dismissed the application filed by the petitioner on the ground that the videos produced by the petitioner will not have relevance to decide the domestic violence complaint. I do not find any error in the impugned order passed by the Trial Court.

5. Accordingly, the Civil Revision Petition stands dismissed. No costs. Consequently, the connected miscellaneous petition is closed. 17-12-2025 Index:Yes/No Speaking/Non-speaking order Internet:Yes nr To The Additional Mahila Court, Egmore.
