This application has been filed seeking leave to sue the respondent/ defendant.

2. The suit has been filed for infringement of trademark, passing off and infringement of patent. From the plaint averments as well as from the averments contained in the affidavit filed in support of this application, it is seen that the goods using the alleged infringed trademark of the plaintiff and patent are being sold at Chennai within the jurisdiction of this Court. Since part of cause of action has arisen within the jurisdiction of this Court, this Court is inclined to grant leave to sue as prayed for. Accordingly, this application is allowed as prayed for. Registry is directed to number the suit, if it is otherwise in order and list the same on 20.12.2024.
