(Order of the Court was made by S.M. SUBRAMANIAM, J.) This petition has been filed to condone the delay of 379 days in filing the above writ appeal.

2.In view of the affidavit filed in support of the miscellaneous petition that the petitioner was holding the post of waiter and not in a position to file an appeal immediately, this Court is inclined to condone the delay.

3.Accordingly, this miscellaneous petition is ordered.

4.Registry is directed to number the Writ Appeal, if it is otherwise in order and post it "for admission".
