ORDER
This application is filed praying to order payment out of a sum of Rs.38,019/-, which is still lying in the Fixed Deposit Account to the credit of O.P.No.126 of 2023, which was invested on 12.02.2025 with Indian Bank, Madras High Court Branch, Chennai-600 104, which carries interest at the rate of 7.3%.
2. The respondent has filed main Original Petition for custody of the minor child and thereafter, the said petition has been disposed of on 24.04.2025. During the pendency of this application, as per the order of this Court, the amount of Rs.38,019/- was deposited by the respondent and now, the applicant wanted to withdraw the amount and hence, this application is filed by the applicant.
3. Learned counsel for the respondent has no objection as the matter has been amicably settled between the parties. As per the compromise, the applicant is entitled to withdraw the amount which was already deposited by the respondent.
4. In view of the above compromise and submissions, this application is allowed. The applicant is permitted to withdraw the amount of Rs.38,019/- (Rupees thirty eight thousand and nineteen only). At this stage, learned counsel 2 / 4
for the respondent submitted that the deposited amount has not been correctly mentioned and the actual deposited amount is Rs.38,875/-. While so, it is made clear that, whatever the amount that had already been deposited by the respondent, the same can be withdrawn by the applicant, along with accrued interest, if any.
