Appln. No.7 of 2025 has been filed seeking to set aside the exparte order of adjudication, dated 27.08.2024 passed in I.P. No.17 of 2024 declaring the Debtor as Insolvent.
2. The Insolvency Petition has been filed based on a decree obtained by the respondent against the petitioner/Debtor. This Court had already granted several adjournments to enable the Debtor to prosecute the Original Side Appeal, which he has filed aggrieved by the judgment and Decree pursuant to which this insolvency petition has been filed.
3. The learned counsel for the Debtor would submit that in the condone delay petition filed by the Debtor, the respondent has taken time to file counter and the matter is to be listed before the Division Bench on 21.07.2025.
4. The learned counsel for the Debtor therefore seeks for a short adjournment to know the outcome of the condone delay petition filed 1/3
before the Division Bench of this Court. However, he would submit that in case, no order for stay is obtained from the Division Bench on the next hearing date i.e., 21.07.2025, this Court shall proceed to hear this application viz., Appln. No.7 of 2025 as well as Appln. No.86 of 2025 filed by the respondent.
5. Post the matter on 28.07.2025.
