No.1359 of 2025 : Sub Appln filed under Section 151 of CPC seeking to dispense with the personal appearance of the applicant /3rd respondent in Sub Application No.1194 of 2025 in Contempt Petition No.503 of 2025 on 10.12.2025 or in the alternative allow the applicant/3rd respondent to appear in virtual mode on 10.12.2025.

Pleader for R2 & R3 COMMON ORDER Earlier, this Court, vide order dated 26.02.2024, directed the respondents to consider the petitioner's representation seeking employment on the ground of land acquisition. Alleging non-compliance of the said direction, the petitioner has filed the present Contempt Petition.

When the contempt petition initially came up for admission on 02.04.2025, the respondents submitted that pursuant to the directions issued by this Court, the petitioner was directed to submit an application and also recorded that the process was under progress and contempt petition was closed. 3/5

3.Subsequently, the petitioner has filed the present Sub-Applications (i) seeking to reopen the Contempt Petition, contending that though an order was passed, the benefit of employment has not been extended to the petitioner's family member and ii)dispense with the personal appearance of the applicant / 3rd respondent.

4. This Court is not inclined to entertain these applications.

5. It is well settled that once the direction of the Court is complied with by passing an order and the Contempt Petition is closed on that ground, the Contempt jurisdiction cannot be invoked again to examine the correctness as to the adequacy or legality of such order. Further, it is known fact that the scope of contempt is limited.

6. In the present case, the respondents have considered the representation and passed an order dated 05.09.2024. Therefore, the Sub-Application seeking to reopen the Contempt Petition is not maintainable, as the Contempt Petition was already closed after recording compliance. Consequently connected sub application is also closed.
