Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, for issuance of Writ of Certiorari, to call for the records in the proceedings vide Na.Ka.No.24935/2017/I1 dated 08.10.2024 of the respondent and quash the same.

ORDER
The Writ Petition has been filed challenging the proceedings issued by the respondent for public auction in Na.Ka.No.24935/2017/11 dated 08.10.2024.
2. On instructions, the learned Government Advocate (Crl.Side) submitted that based on the complaint received against the petitioner and others, the respondent police registered Crime. No.4 of 2013 for the offence under Sections 120(b), 406, 420 IPC and Section 5 of TNPID Act, in pursuant to the registration of FIR, the property belonging to the petitioner was attached in G.O.Ms.No.911 Home (Police-XIX) Department, dated 08.12.2017. Thereafter, the attachment order was made absolute in O.A. No.2 of 2020 by order dated 05.04.2021 on the file of the TNPID Special Court, Coimbatore.

Further, the learned Government Advocate submits that auction notice was published on 22.10.2024 and auction was conducted on 07.11.2024 and the two properties were sold for Rs.91,00,000/- and Rs.2,6,00,000/-. The auction purchaser remitted the entire sale value to the Competent Authority and the properties were also registered in favour of the auction purchaser on 13.01.2025.
4. He further submitted that the petitioner is being an accused in Crime No.4 of 2014, the petitioner duly served notice while passing attachment order and it was made absolute by the TNPID Court, therefore
all the procedures were duly followed. Hence, this Court finds no merits in this petition. Accordingly, this Writ Petition is dismissed. Consequently, connected Miscellaneous Petitions are also dismissed. No costs.
