ORDER

The suit was framed as a summary suit. The leave to defend application was allowed, subject to the defendant depositing a sum of Rs.15,00,000/- in the form of Fixed Deposit (FD) No.40938462441, dated 25.04.2022, drawn on State Bank of India, Balaji Nagar Branch, Chennai, in favour of Registrar General of this Court. Subsequently, by judgment and decree dated 13.10.2023, the suit was dismissed.

2. Learned counsel for the plaintiff confirms that no appeal has been filed against the dismissal of the suit.

3. In view of such dismissal, learned counsel for the defendant submits that the fixed deposit is liable to be endorsed in favour of the defendant. This request is liable to be accepted. Accordingly, the Registrar General of this Court is directed to take necessary steps, including byway of making an appropriate endorsement, so as to enable the defendant to receive the sum of Rs.15,00,000/-.
