This Criminal Original Petition is filed to direct the first respondent to consider the representation of the petitioner dated 09.12.2024, wherein and whereby, he sought to transfer the case in Crime No.395 of 2024 pending on the file of the second respondent to the third respondent herein viz., Inspector of Police, District Crime Branch, Krishnagiri District.

2. Heard both sides.

3. Learned Additional Public Prosecutor appearing for the respondents, on instructions, submitted that based on the complaint given by the petitioner herein, the second respondent-Police registered a case in Crime No.395 of 2024. During the investigation, the petitioner/defacto complainant was summoned and his statement was recorded under Section 164(1) Cr.P.C and investigation is under progress. 2/4

4. Considering the facts and circumstances and also considering the submission made by the learned Additional Public Prosecutor, this Court does not find any valid ground to transfer the case in Crime No.395 of 2024 from the file of the second respondent-Police to the third respondent-Police.

5. Accordingly, this Criminal Original Petition is dismissed. It is open to the petitioner to work out his remedy after filing of charge-sheet, if he is so desired.
