The petitioner / wife has come up with the above transfer petition, seeking to withdraw O.P.No.226 of 2024 before the Family Court at Tiruvannamalai and transfer the same to the file of the Family Court at Chennai.

The learned counsel for the petitioner/wife submits that the petitioner has filed a petition in H.M.O.P.No.4960 of 2024 on the file of the III Additional Family Court, Chennai seeking judicial separation from the respondent. The respondent-husband has filed a petition to restitution of conjugal rights in O.P.No.226 of 2024 before the Family Court, Tiruvannamalai.

3. Despite service of notice in the above transfer petition, the respondent/husband has neither chosen to appear in person nor through counsel. The name of the respondent is also printed in the cause list. The respondent is called and set ex-parte. Hence, I have proceeded to hear the learned counsel for the petitioner. I have also gone through the affidavit filed in support of the request for transfer.

4. The petitioner has stated that the O.P. has been filed in a Court about 200kms away from her residence, requiring nearly 5-6 hours of travel one way. To attend each hearing, she has to cover around 400kms in a day. He further stated that she is dependent on her single mother, who is suffering from health issues, and that it is very difficult for him to travel such a long distance with his 5 year old child. She has also expressed her difficulty in travelling 2/4

from Chennai to Tiruvannamalai to attend the proceedings. I am satisfied that the petitioner has made out a good ground for allowing the transfer petition.

5. In the light of the above, this Transfer Civil Miscellaneous Petition is allowed. The case in O.P.No.226 of 2024 is withdrawn from the file of the Family Court at Tiruvannamalai and transferred to the file of the Family Court, Chennai. Considering the facts there shall be no orders as to costs.
