IN THE HIGH COURT OF JUDICATURE AT MADRAS

DATED: 06.10.2025

CORAM:

THE HONOURABLE MR. JUSTICE D.BHARATHA CHAKRAVARTHY Suo Motu TR.Nos.18324 and 18344 of 2025 (C.C.Nos.41 of 2019 and 100136 of 2018 of Judicial Magistrate Court, Harur Taluk, Dharmapuri) For Petitioner : Ms.G.V.Kasthuri Additional Public Prosecutor COMMON ORDER These Suo Motu cases are dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.)No.618 of 2025.

2. These cases are registered for alleged offences under Sections 392 and of Indian Penal Code. These two cases are split up out of the same case. The allegation in this case is that the accused extorted money from the defacto complainant using a knife. However, only part amount has been recovered. Presently, the defacto complainant is not traceable. Non Bailable Warrant is pending against the accused.

3. Considering the factual matrix, context of the case, the antecedents of the accused, the reason for absence from their usual place, and the submission that, despite best efforts, the warrant could not be executed, it is evident that even if the accused is brought to face trial, it would impinge upon their right to a speedy trial. Due to the passage of time, a meaningful trial is unlikely, and no useful purpose would be served.
