ORDER
The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 6 read with 20(1) of Cigarettes ad Other Tobacco Products Act, 2003, and Section 279 and 328 of IPC and Section 4(1)(a) of Tamil lNadu Prohibition Act, in Crime No.120 of 2024 on the file of the respondent police, seeks anticipatory bail.
2.This is the fourth anticipatory bail application was filed before this Court. The case of the prosecution is that the petitioner along with other accused persons were found in illegal possession of 671 Kgs of banned tobacco products worth about more than Rs.15 lakhs. Hence, the complaint. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioner.
4.The learned Government Advocate (Criminal Side) appearing for the respondent submitted that earlier applications filed for anticipatory bail have been dismissed by this Court and this is the fourth anticipatory application. There is no chane of circumstances. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.
5.Considering the facts and circumstances of the case that the petitioner is found in illegal possession of 671 Kgs of banned tobacco products worth about more than Rs.15 lakhs, and he is involved in a very serious offence, this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. 23-01-2025 mps
