ORDER

Apprehending arrest in connection with Crime No.173 of 2024 registered for the offences punishable under Sections 191(2), 191(3), 329(4), 296(b), 118(1), 351(3) of BNS 2023 and Section 4 of Tamil Nadu Property (Prevention of Damage and Loss) Act, 1992, the present petition has been filed seeking anticipatory bail.

2. Pleading innocence on the part of the petitioner, false implication in the case, learned counsel for the petitioner seeks indulgence of this Court. Learned counsel for the petitioner would submit that the allegation as against the petitioner is that the petitioner along with co-accused trespassed into the defacto-complainant house and abused her filthy language and also caused damage to the household articles. He further submitted that the first accused and the defacto complainant's daughter were in love and due to which false case has been foisted as against the petitioner and others. 3.

The case of the prosecution as putforth by the learned Government Advocate (Crl. Side) appearing for the respondent Police, opposing for grant of anticipatory bail, is that the defacto complainant's

daughter is studying 12th standard and 01.10.2024, the petitioner and other accused trespassed into the defacto complainant's house and abused her with filthy language and attacked the defacto complainant and her daughter. The accused persons damaged the household articles worth about Rs.80,000/-. He further submits that second accused has five previous cases.

Considering the facts and circumstances of the case and the fact that the petitioner has committed very heinous offence as against the minor victim girl and hence, this Court is not inclined to grant bail to the petitioner.

Accordingly, this Criminal Original Petition stands dismissed.
