ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case, Cr.No.783 of 2016 was registered for the alleged offence under Section 51 (b) r/w. 65 of Copyright Act, 1957. The occurrence is of the year 2016. The allegation in this case is that the accused was found to be in possession of pirated CD's and the case is pending at summons stage. 3.Considering the nature of the allegation and the accused facing the case since 2016, the reason for absence from his usual place, and the submission that, despite best efforts, the summons could not be served, it is evident that even if the accused is brought to face trial, further continuation of the trial would impinge upon the right to a speedy trial of the accused. 4. Accordingly, the case in STC.404748/2016 on the file of the Judicial Magistrate Court, Udhagamandalam Taluk, Nilgiris, stands quashed. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
