2. The Thasildar, Pethanaickenpalayam, Salem District.

... Respondents Prayer: Writ petition filed under Article 226 of Constitution of India seeking for issuance of Writ of Mandamus, directing the first respondent to dispose of the appeal filed on 27.04.2024, challenging the order passed by the second respondent, dated 25.04.2024, within a stipulated time frame as fixed by this court. For Petitioner : Mr.R.Sripriya For Respondents : Mr.S.Balamurugan, Government Advocate

ORDER

The petitioner herein seeks a direction to the first respondent to dispose of the appeal filed by him dated 27.04.2024, challenging the order passed by the second respondent dated 25.04.2024, rejecting the request of the petitioner, seeking correction in the Birth Certificate of his son.

2. It is the case of the petitioner that his son's correct date of birth was 17.01.2000, however, in the birth certificate issued, date of birth is mentioned as 18.01.2000. Therefore, the petitioner submitted a representation before the second respondent seeking correction of date of birth and the same was rejected by the second respondent by order dated 25.04.2024. Aggrieved by the same, the petitioner preferred an appeal before the first respondent and the same is pending without any progress. Hence the petitioner has come before this court seeking above direction.

3. Mr.S.Balamurugan, learned Government Advocate, who takes notice for the first and second respondents would submit that the

appeal pending on the file of the first respondent will be disposed of on its own merits, within a time frame, as fixed by this court.

4. In view of the above submission, without going into the merits of the claim made by the petitioner, the first respondent is directed to dispose of the appeal filed by the petitioner dated 25.04.2024, within a period of four weeks from the date of receipt of a copy of this order.

5. With the above direction, this writ petition is disposed of. There shall be no order as to costs.
