ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. This case is registered for the alleged offences under Sections 302, 120B, 379 and 109 of Indian Penal Code, 1860. The alleged occurence of murder took place in the year 2018. At present, the defacto complainant and the other relatives of the victim are not traceable. All the accused are said to be from North India and their addresses have not been verifiable until date. They continue to remain absconding, summons could not be served on them, and the warrants issued against them are till pending and could not be executed.

However, considering the nature of the offence, this is an extraordinary case for invoking the power under Article 226 of the Constitution of India read with 482 of the Code of Criminal Procedure to close the case, but with liberty to the prosecution to reopen and proceed with the case as and when the accused are secured or any information regarding their whereabout is traced in future.

4. With the above liberty kept open, this P.R.C.No.6 of 2019 on the file of Judicial Magistate Court, Kangeyam, Kangeyam Taluk, Tiruppur is closed and this Suo Motu Transfer Case stands disposed of. 17.10.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
