ORDER

The above Miscellaneous Petition is filed to recall the order dated 28.11.2024 passed in W.P.No.35581 of 2024 thereby giving the petitioner an opportunity of hearing in the above Writ Petition.

2. The recall petition has been made on the ground that the order dated 28.11.2024 has been made on a wrong statement that pending the interim stay the revenue records have been mutated. According to the petitioner the revenue records were not mutated when the stay was in force. The petitioner would submit that the patta had been obtained on 18.01.2019 whereas the earlier Writ Petition (W.P.No.1825 of 2019) was filed on 22.01.2019 and the interim order was obtained on 24.01.2019. The records would also confirm the above.

3. Therefore, the above Miscellaneous Petition is allowed and the order passed by this Court in W.P.No.35581 of 2024 dated 28.11.2024 is recalled.

4. Post the matter on 28.02.2025.
