PRAYER The Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure seeking to withdraw OP No.4165/2024 pending on the file of the I Additional Pricipal Judge, Family court Chennai and transfer the same to Family court , Coimbatore.

ORDER

Heard both side learned counsel.

2.Mrs.Srividhya Aravindan, learned counsel for the respondent, fairly states that the husband may not have any serious objection for acceding to the transfer request made by the wife, however she would only bring to the notice of the Court that the petitioner has been travelling alone even to Singapore and there should be no difficulty for the petitioner to come down to Chennai to attend the proceedings.

3.She would further state that since the respondent is employed in Singapore, there is no direct flight to Coimbatore and in the event of a transfer being ordered as prayed for, a direction may be issued to the Family Court, Coimbatore, to permit the respondent/husband to appear through video conferencing facility, except for the purpose of cross-examination, for which he undertakes to appear in person.

4.In light of the above submissions;

(i) the Transfer Civil Miscellaneous Petition is allowed. O.P. No. 4165 of 2024 is withdrawn from the file of the I Additional Principal Judge, Family Court, Chennai, and transferred to the file of the Family Court, Coimbatore. (ii) The Family Court, Coimbatore, is directed to not insist on the physical presence of the respondent/husband on all hearing dates and shall permit his appearance through video conferencing or through the counsel appointed by the respondent/husband.

(iii)However, it is made clear that the respondent/husband shall appear in person for the purpose of cross-examination. Considering that he is travelling

from Singapore, the Family Court shall ascertain convenient dates from the respondent before scheduling the cross-examination. (iv)There shall be no order as to costs.
