O R D E R

The petitioners, who apprehend arrest at the hands of the respondent police in respect of the Non-Bailable Warrant issued by the learned Sessions Judge, Special Court for Trial of Cases under SC/ST (PoA), Act, Tiruppur in S.C.No.45 of 2024, arising out of Crime No.732 of 2023, for the alleged offence under Sections 294(b), 324, 506(2), 307 & 341 of IPC., seek anticipatory bail.

When the matter is taken up for hearing today, the learned counsel for the petitioners submitted that the petitioners are arrayed as accused in S.C.No.45 of 2024, and that due to their nonappearance, the Trial Court issued a Non-Bailable Warrant against them on 15.09.2025. It is further submitted that the petitioners are now ready and willing to appear before the Trial Court and cooperate with the trial proceedings, and therefore, he prays for the grant of anticipatory bail to the petitioners.

Learned Government Advocate (Criminal Side)

appearing for the respondent police submitted that based on the complaint given by the defacto complainant, a case in Crime No.732 of 2023 has also been registered for the offences under Sections 294(b), 324, 506(2), 307 & 341 of IPC., against the petitioners. After completing the investigation, the respondent police filed a final report and the same was taken cognizance by the Trial Court in S.C.No.45 of 2024. Since the petitioners failed to appear for the trial, the Trial Court issued a NonBailable Warrant against them on 15.09.2025 and the case is now pending trial.

Considering the submissions made by the learned counsel appearing on either side, and taking into account the fact that a NonBailable Warrant is pending against the petitioners, this Court is of the view that it would be appropriate to direct the petitioners to appear before the Trial Court, by filing an appropriate petition to cancel the said Non-Bailable Warrant.

Accordingly, the petitioners are directed to appear before

the Trial Court concerned by filing appropriate application to cancel the Non-Bailable Warrant issued against them. If such an application is filed, the Trial Court is directed to consider the said application on the very same day on its merits and in accordance with law. 6.

With the above directions, this Criminal Original Petition stands disposed of.
