ORDER
The Writ Petitioner seeks for issuance of Writ of Mandamus, to direct the first respondent to take appropriate action upon petitioner representation, dated 29.09.2025.
2. According to the petitioner, the election to the flat owners' association is being held contrary to the Rules. The case of the petitioner is that the election notification has been issued on 12.09.2025 and on 29.09.2025, a detailed representation has been given by the petitioner along with 17 other members to the first respondent and the first respondent in and by this Writ Petition, is being called upon to dispose of the representation.
3. Though the petitioner has sought for an interim stay of the Elections pending disposal of the Writ Petition, I find that since the Election has already been notified even as early as on 12.09.2025, I am not inclined to grant any interim order.
4. It is also brought to my notice that the election is stated to be held on 02.10.2025, 03.10.2025 and 04.10.2025, and tomorrow being the last date, at this stage, I do not intend to pass any orders stopping the election process that has already commenced. However, the election results shall not be announced for a period of two weeks from the date of receipt of a copy of this order. The first respondent is directed to pass orders on the petitioner's representation dated 29.09.2025, within the said period of two
weeks. It is made clear that the result of the election, is subject to the orders being passed by the first respondent on the representation of the petitioner, dated 29.09.2025.
