The petitioner, who was arrested and remanded to judicial custody on 05.08.2025, for the offence punishable under Sections 8(c), 20(b)(ii)(C), 25 & 29(1) of NDPS Act, 1985 in Crime No.318 of 2025, registered on the file of the respondent, seeks bail.

2. The allegation against the petitioner is that the petitioner along with other accused person had entered into a conspiracy for illicit transportation and sale of contraband of 108.895 kgs of Ganja. Hence the case.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays to grant bail to the petitioner.
4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that, apart from this case, petitioner has 8 previous cases. Hence, he strongly opposed the grant of bail to the petitioner.
5. Heard both sides and perused the materials available on record.
6. Considering the bad antecedents of the petitioner and also the fact that, petitioner involved in possession and transportation of 108.895 kgs of ganja, if the petitioner is granted bail, he will indulge in similar activities, 2/4
and rigors of Section 37 of NDPS Act is also applicable to this case. Hence, this Court is not inclined to grant bail to the petitioner.
